Terms of Service
Effective date: 15 September 2026
These Terms of Service (the "Terms") form a binding agreement between PerfeXe, registered at Office 1204, Business Bay Tower, Business Bay, Dubai, United Arab Emirates ("PerfeXe", "we", "us"), and the individual or organisation accessing or using the PerfeXe platform ("you"). By creating an account, purchasing a subscription, or otherwise using the platform, you agree to these Terms. If you do not agree, do not use the platform.
1. The service
PerfeXe is a software-as-a-service platform made available over the internet on a subscription basis. We may add, change, or remove features as the platform develops. Where a change materially reduces the functionality of a paid plan, we will give reasonable advance notice.
2. Eligibility and account registration
- You must be at least 18 years old, or the age of majority in your jurisdiction, and legally able to enter into a contract.
- You must provide accurate, current, and complete registration information and keep it up to date.
- If you register on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms.
- One account may not be shared between multiple individuals except as permitted by your plan's seat or user allowance.
3. Your responsibilities
You are responsible for all activity that takes place under your account. You agree to keep your credentials confidential, to use a strong and unique password, to enable any available additional authentication measures, and to notify us at support@perfexe.com without undue delay if you suspect unauthorised access. You are responsible for the lawfulness of the content and data you upload to or process through the platform, and for obtaining any consents required for that data.
4. Subscriptions, billing, and renewals
- Paid plans are offered on a recurring subscription basis for the billing period shown at checkout (for example monthly or annual).
- Prices are stated on our pricing page or in your order confirmation. Applicable sales tax, VAT, or GST may be added and is shown before payment is taken.
- Subscriptions renew automatically at the end of each billing period at the then-current price for your plan, unless cancelled before the renewal date.
- We may change subscription pricing. Price changes take effect at your next renewal and we will give reasonable advance notice by email.
- If a payment fails, we may retry the charge and may suspend access to paid features until payment is successfully collected.
5. Payment processing and Paddle
Payments for PerfeXe subscriptions are processed by Paddle.com Market Ltd and its affiliates ("Paddle"). Paddle acts as the Merchant of Record for these transactions, which means Paddle is the seller of record, handles the payment, issues the invoice or receipt, and is responsible for collecting and remitting applicable sales taxes.
Your purchase is therefore also subject to Paddle's buyer terms and privacy notice, which are available on Paddle's website. We do not receive or store your full payment card details. Paddle provides us with limited transaction information, such as your name, billing country, the plan purchased, and the transaction status, so that we can provide the service and support your account.
6. Cancellation
You may cancel your subscription at any time from your account settings or by contacting support@perfexe.com. Cancellation stops future renewals. Unless our Refund Policy or applicable law provides otherwise, cancellation does not generate a refund for the current billing period, and you retain access to paid features until the end of that period.
7. Free trials and promotional offers
Where a free trial or promotional discount is offered, the applicable duration and conditions are stated at sign-up. Unless you cancel before the trial ends, the subscription converts to a paid plan and billing begins. Trials and promotional offers are limited to one per customer unless we state otherwise.
8. Acceptable use
You agree not to use the platform to:
- break any applicable law or regulation, or infringe the rights of any third party;
- upload, transmit, or distribute malware, harmful code, or unlawful, abusive, harassing, defamatory, or deceptive content;
- send unsolicited bulk messages, or engage in phishing or fraudulent activity;
- attempt to gain unauthorised access to the platform, other accounts, or our infrastructure, or to bypass usage limits, rate limits, or security controls;
- reverse engineer, decompile, copy, or create derivative works from the platform, except to the extent this restriction is prohibited by law;
- resell, sublicense, or provide the platform to third parties as your own service, unless expressly permitted in writing;
- use automated means to scrape or extract data from the platform beyond any documented API, or place unreasonable load on our systems.
9. Intellectual property
The platform, including its software, design, user interface, documentation, and the PerfeXe name and branding, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the platform for your internal business purposes during your subscription term. No other rights are granted.
You retain all rights in the content and data you submit to the platform ("Your Content"). You grant us a limited licence to host, copy, transmit, display, and process Your Content solely to operate, secure, support, and improve the service for you. If you send us feedback or suggestions, we may use them without restriction or obligation to you.
10. Third-party services
The platform may integrate with or link to third-party services. Those services are governed by their own terms and privacy policies, and we are not responsible for their availability, content, or practices. Your use of an integration may require you to authorise the exchange of data between PerfeXe and that provider.
11. Service availability and support
We aim to keep the platform available and reliable, but we do not guarantee uninterrupted access. Planned maintenance, updates, third-party outages, and events outside our reasonable control may affect availability. Where we have agreed a separate service level commitment in writing, that document applies. Support is provided by email at support@perfexe.com during normal business hours.
12. Disclaimers
To the maximum extent permitted by law, the platform is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will meet your requirements, that it will be error-free, or that any result obtained through it will be accurate. Nothing in these Terms limits statutory rights that cannot be limited under applicable consumer law.
13. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, business, or data, arising out of or relating to these Terms or the platform, even if advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to these Terms or the platform is limited to the total amount you paid for the subscription in the twelve (12) months immediately preceding the event giving rise to the claim. These limitations do not apply to liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud.
14. Indemnity
You agree to indemnify and hold us harmless from claims, damages, liabilities, and reasonable costs arising from your breach of these Terms, your unlawful use of the platform, or Your Content infringing the rights of a third party.
15. Suspension and termination
We may suspend or terminate your access, in whole or in part, if you materially breach these Terms, if your account is used unlawfully or in a way that threatens the security or integrity of the platform, if payment is not received when due, or if we are required to do so by law. Where practical and lawful, we will give notice and an opportunity to remedy the breach.
You may terminate at any time by cancelling your subscription and closing your account. On termination, your right to use the platform ends. We may delete your data after the retention period described in our Privacy Policy, so you should export anything you need before closing your account.
16. Changes to these Terms
We may update these Terms to reflect changes to the platform, our business, or legal requirements. We will post the updated Terms on this page with a revised effective date and, where the change is material, notify you by email or in-product notice. Continuing to use the platform after the change takes effect means you accept the updated Terms.
17. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates, and the courts of the United Arab Emirates have exclusive jurisdiction over any dispute, without prejudice to any mandatory right you may have to bring proceedings in your country of residence. Before starting formal proceedings, we ask that you contact us so we can try to resolve the matter.
18. General
If any provision of these Terms is found unenforceable, the remainder continues in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with any order form and our published policies, form the entire agreement between us regarding the platform.

This Privacy Policy explains how PerfeXe ("PerfeXe", "we", "us"), of Office 1204, Business Bay Tower, Business Bay, Dubai, United Arab Emirates, collects, uses, shares, and protects personal information when you visit our website, create an account, or use the PerfeXe platform. For the personal information we handle about our own users and customers, we act as the data controller.
1. Information we collect
Information you give us. Account details such as your name, email address, password (stored only as a cryptographic hash), organisation name, job role, billing country, and any information you add to your profile or submit through support requests and forms.
Content and data you process. Files, records, text, and other data you upload to or create in the platform, together with the account settings and configuration you apply.
Billing information. Our payment provider Paddle collects and processes your payment details. We receive limited transaction information from Paddle, such as your name, billing country, plan, currency, amount, tax status, and whether a payment succeeded. We do not receive or store full payment card numbers.
Information collected automatically. Technical and usage information such as IP address, approximate location derived from it, browser and device type, operating system, language, referring page, pages and features viewed, actions taken, timestamps, and diagnostic or error logs.
Communications. Records of correspondence with our support, sales, and security teams.
2. How we use personal information
- To create and administer your account and provide the platform's features.
- To process subscriptions, invoices, renewals, and refunds, with Paddle acting as Merchant of Record.
- To provide customer support and respond to your enquiries.
- To secure the platform, detect and prevent fraud, abuse, and unauthorised access, and keep audit and security logs.
- To monitor performance, diagnose faults, and improve and develop features, using aggregated or de-identified data where practical.
- To send service and administrative messages, such as billing notices, security alerts, and changes to our policies.
- To send product updates and marketing where you have consented or where permitted by law, with an unsubscribe link in every marketing message.
- To comply with legal, tax, and accounting obligations, and to establish, exercise, or defend legal claims.
3. Legal bases for processing
Where data protection law such as the UK GDPR or EU GDPR applies, we rely on: performance of a contract, to provide the platform you have subscribed to; legitimate interests, to secure and improve the service and to run our business fairly and proportionately; consent, for optional cookies and marketing where consent is required, which you may withdraw at any time; and legal obligation, for tax, accounting, and lawful requests from authorities.
4. Cookies and similar technologies
We use cookies and similar technologies such as local storage for the following purposes:
- Strictly necessary โ to sign you in, keep your session active, remember your preferences, balance load, and protect against fraud and abuse. These cannot be switched off without breaking the service.
- Functional โ to remember interface choices such as language, timezone, or layout.
- Analytics โ to understand aggregate usage so we can improve the platform. Where consent is required, these are set only after you agree.
You can manage or delete cookies through your browser settings, and where we provide a cookie banner you can change your choices at any time. Blocking necessary cookies may prevent parts of the platform from working. This legal policies page itself sets no cookies and loads no third-party content.
5. Sharing personal information
We do not sell personal information. We share it only as described here:
- Payment processing. Paddle, as Merchant of Record, processes your purchase, tax, invoicing, and refunds under its own privacy notice.
- Service providers. Vetted suppliers who process data on our behalf under written contracts, including cloud hosting and storage, email delivery, customer support tooling, error monitoring and analytics, and accounting services.
- Your organisation. If your account belongs to a team or organisation account, administrators of that account may access your account details and activity within it.
- Legal and safety. Authorities, regulators, or advisers where disclosure is required by law or necessary to protect our rights, our users, or the public.
- Corporate transactions. A prospective buyer or successor in a merger, acquisition, financing, or sale of assets, subject to confidentiality and this Policy.
6. International data transfers
We and our service providers may process personal information in countries other than your own, including outside the country in which you are located. Where we transfer personal information out of the UK, the European Economic Area, or another region with transfer restrictions, we use an appropriate safeguard, such as an adequacy decision, the UK International Data Transfer Agreement or Addendum, or the European Commission's Standard Contractual Clauses, together with additional technical and organisational measures where needed.
7. Data retention
We keep personal information only as long as necessary for the purposes set out above. Account and content data are kept for the life of your account and deleted or anonymised within a reasonable period after account closure, unless we must keep them longer. Billing and tax records are kept for the period required by applicable tax and accounting law. Security, audit, and diagnostic logs are kept for a limited period appropriate to their purpose. Support correspondence is kept for as long as needed to handle your request and to resolve related disputes.
8. Security
We apply technical and organisational measures appropriate to the risk, including encryption of data in transit, access controls and least-privilege permissions for staff, hashed password storage, logging and monitoring, regular patching, backups, and supplier due diligence. No system can be guaranteed completely secure. If a personal data breach occurs that is likely to result in a risk to your rights, we will notify you and the relevant authority as required by law.
9. Your privacy rights
Depending on where you live, you may have the right to:
- access a copy of the personal information we hold about you;
- have inaccurate or incomplete information corrected;
- have your personal information erased where there is no continuing lawful reason to keep it;
- restrict or object to certain processing, including processing based on legitimate interests;
- receive your data in a portable, machine-readable format;
- withdraw consent where processing is based on consent;
- opt out of marketing communications at any time;
- not be subject to a decision based solely on automated processing that has a legal or similarly significant effect on you. We do not use such decision-making on the platform.
To exercise a right, contact privacy@perfexe.com. We may need to verify your identity before acting, and we will respond within the period required by applicable law. You can also complain to the data protection authority in the United Arab Emirates or in your country of residence.
10. Children's privacy
The platform is not directed at children and is not intended for anyone under 18. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact privacy@perfexe.com and we will delete it.

Refund Policy
Effective date: 15 September 2026
This Refund Policy explains when and how you can request a refund for a PerfeXe subscription. It forms part of our Terms of Service and applies to purchases made through our payment provider Paddle, which acts as Merchant of Record for PerfeXe.
1. Refund eligibility
You may request a full refund of a subscription payment if you contact us within 14 days of the date of that payment and the payment relates to your first purchase of the plan or to a renewal you did not intend to make.
We will also refund, regardless of the period above:
- duplicate charges or charges taken in error;
- payments taken after you cancelled and were confirmed as cancelled;
- cases where the platform was materially unavailable or defective for a sustained period and we were unable to resolve the issue for you;
- any refund we are required to provide under applicable consumer or distance-selling law, including statutory cancellation rights where they apply.
2. Exclusions
Refunds are not normally available where:
- the request is made after the period stated in section 1 has passed;
- the subscription period has been substantially used, other than where a legal right to a refund applies;
- the account was suspended or terminated for breach of our Terms of Service, including abuse, fraud, or unlawful use;
- the request relates to a free trial, a promotional credit, or a plan provided at no charge;
- the request relates to a custom, bespoke, or professional-services engagement already delivered, unless the applicable order document says otherwise;
- third-party charges, such as fees from an app store or a service you purchased separately, are involved. Those must be claimed from that provider;
- the request is a repeat claim for a period already refunded.
We may decline requests that show a pattern of repeated purchase-and-refund activity.
3. How to request a refund
Email support@perfexe.com with the subject "Refund request" and include:
- the email address on your PerfeXe account;
- the Paddle order, invoice, or receipt number;
- the date and amount of the payment;
- a short description of the reason for the request.
You may also contact Paddle directly using the details on your invoice or receipt, since Paddle is the seller of record for your transaction.
4. Processing time
We aim to acknowledge refund requests within two business days and to make a decision within five business days. Where a refund is approved, Paddle issues it to the original payment method. Funds typically appear within five to ten business days, depending on your bank or card issuer. Currency conversion differences and any fees applied by your bank are outside our control.
5. Partial refunds and credits
Where a full refund is not appropriate, we may offer a pro-rata refund, an account credit, or an extension of your subscription term. Any such offer is discretionary unless applicable law requires otherwise, and it does not affect your statutory rights.
6. Subscription cancellation
Cancelling a subscription and requesting a refund are separate actions. You can cancel at any time from your account settings or by emailing support@perfexe.com. Cancellation prevents further renewals and takes effect at the end of the current billing period, during which you keep access to paid features. Cancelling alone does not refund a payment already taken, so send a refund request as well if you believe one is due.
7. Chargebacks
If you believe a charge is incorrect, please contact us before raising a chargeback with your bank. Chargebacks are slower to resolve for both sides and may result in the affected account being suspended until the dispute is closed.
8. Taxes
Where a refund is issued, any sales tax, VAT, or GST collected on the original transaction is refunded in line with the applicable tax rules and Paddle's processes as Merchant of Record.
9. Changes to this Policy
We may update this Refund Policy. The version published on this page at the time of your purchase applies to that purchase. Material changes will be announced by email or in-product notice.
